Lap-Band Weight Loss Class Action

We have commenced a proposed class proceeding on behalf of individuals in Canada who were implanted with the medical device Lap-Band.

The Lap-Band is a laparoscopic adjustable gastric band implant marketed as a means to assist with weight loss in adults. The Lap-Band has a high failure, injury, and complication rate. These complications often result in the need for one or more corrective surgeries and often lead to permanent damage. The unacceptably high risks of the Lap-Band outweigh the benefits purportedly conferred by the device.

If you were implanted with a gastric band and/or want more information about this proceeding, please contact us. This action is still in its early stages and we will provide more information as it becomes available.

Developments

The action is currently being case managed by Justice Milman of the British Columbia Supreme Court. We anticipate applying to certify the action as a class proceeding under the Class Proceedings Act in the fall of 2018.
